BOMcheck has been updated to Version 7.3 to include five new SVHCs and additional substances detailed below. The following 20-minute video explains what types of materials and parts can contain the new declarable substances and how to update your Regulatory Compliance Declarations (RCDs).

Substance Details

New REACH Candidate List Substances

On 14 June 2023, the European Chemicals Agency added nine new substances to the REACH Candidate List which now contains 235 substances.

To ensure alignment with the IEC62474 screening of these substances, both SVHCs will be added to BOMcheck and require supplier declarations.

New Proposition 65 substances

OEHHA added 3 new substances to the Proposition 65 List (officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986) on 11 August 2023. 1 out of 3 new substances will be added to BOMcheck.

  • Dimethyl hydrogen phosphite

1 out of 3 new substances has been screened out as unlikely to be present in supplied articles and result in exposure to the consumer and therefore does not require notification.

  • Anthracene

2-Bromopropane was already included on the Proposition 65 List for male and female reproductive toxicity and so it has not been added to BOMcheck again.

EU POPs additions and updates

Two new substances will be added to the Other Restricted and Declarable Substances list in BOMcheck. The following substances have been added to the Stockholm Convention and will become restricted under Annex 1 of EU POPs Regulation (EU) 2019/1021.

  • Dechlorane Plus
  • UV-328

The below substance has also been restricted under Annex 1 of EU POPs Regulation (EU) 2019/1021 but it has already been added to BOMcheck and no new entry is required.

  • PFHxS, it's salts and PFHxS related compounds

New substances restricted under REACH Annex XVII

The following 2 new substances will be added to the REACH Restrictions (Article 67) list:

Lead and its compounds in PVC

  • The European Union published the Commission Regulation on May 8 amending Entry 63 of Annex XVII to REACH Regulation regarding lead and its compounds in PVC. Lead shall not be placed on the market or used in articles produced from polymers or copolymers of vinyl chloride (PVC) with a concentration of more than 0.1% by weight of the PVC material, effective November 29, 2024.

Formaldehyde and formaldehyde releasers

  • On 17 July 2023, the European Union’s Official Journal (OJEU) published Regulation (EU) 2023/1464 1, which added a new restriction on formaldehyde released from articles under Annex XVII to REACH regulation as entry 77. The new restriction concerns consumer exposure to formaldehyde in indoor environments.

New substance added to the France Dangerous Substances List

Order of August 30, 2023 relating to the identification of dangerous substances in products generating waste requires consumer information relating to the presence of a dangerous substance when it is present in a concentration greater than 0.1% by weight in a substance, mixture or article.

The following substance has been added to the Other Restricted and Declarable Substances list in BOMcheck as it may be present >0.1% w/w in supplied articles.

  • Diisooctyl phthalate (DIOP)

Updated EU MDR (CMR 1A & 1B) substances

The CMR 1A & 1B substances list in the RCD tool will be updated to include additional substances from the 20th ATP and new SVHCs. The entry for CMR 1A & 1B substances in the RCD tool will be set to missing for all suppliers due to the updated list.

Updating Declarations

Further communications and guidance will be sent to all BOMcheck users ahead of the v7.3 update detailing the launch date and explaining how users can update their Regulatory Compliance Declarations (RCDs) for these new substances.

After the release of v7.3 the BOMcheck team will publish a guidance webinar giving step-by-step instructions on how users can update RCDs in BOMcheck.
